Terms of service

These Terms of Service (“Terms”) govern your use of morenocalifornia.com and purchases from Moreno Interior LLC, doing business as Moreno California (“Moreno,” “we,” “us,” or “our”). By using the store or placing an order, you agree to these Terms. If you do not agree, do not use the store.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited, including mandatory consumer rights.

Eligibility and store use

You must be legally capable of entering a binding contract in your jurisdiction or use the store with the permission and supervision of a parent or legal guardian. You agree to provide accurate, current information and not use the store for unlawful, fraudulent, abusive, or disruptive purposes.

You may not interfere with the store’s operation, probe or circumvent security, introduce malicious code, scrape the store in violation of law or these Terms, impersonate another person, infringe intellectual-property rights, or use store content for unauthorized commercial purposes.

Product information

We try to describe and display products accurately. Screen settings, photography, and natural production variation may affect how colors, packaging, and other details appear. Product availability, packaging, formulation, and specifications may change when reasonably necessary, subject to applicable law.

Fragrance perception is personal. Descriptions and scent notes communicate the intended character of a product but do not guarantee that every customer will perceive it identically.

Follow all instructions, warnings, and care guidance supplied with candles and soaps. For candles, allow the wax to melt to the edge on the first burn, trim the wick to 5 mm before each burn, never burn for longer than four hours at a time, and stop use when 5 mm of wax remains. Never leave a burning candle unattended and keep it away from children, pets, drafts, and flammable materials. Discontinue use of any product that causes irritation and seek appropriate medical advice when necessary.

Damage, reduced performance, or injury caused by misuse, overburning, failure to trim the wick, disregard of warnings, or other use contrary to the supplied instructions is not a product defect. Nothing in this paragraph excludes liability or consumer remedies that cannot legally be excluded.

Orders and acceptance

Submitting an order is an offer to purchase. An automated confirmation acknowledges receipt but does not necessarily constitute acceptance. We may accept an order by confirming fulfillment or shipment.

We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, inventory error, pricing error, shipping restriction, or violation of these Terms. If payment was captured for an order we cancel, we will refund it to the original payment method.

Prices, taxes, and payment

Prices are shown in the currency presented for the applicable market. Taxes, shipping charges, duties, and other costs are shown at checkout when Shopify can calculate them. You authorize the selected payment provider to charge the total displayed at checkout.

We may correct inadvertent pricing or product-information errors. If a material correction affects an order already submitted, we will contact you and provide any remedy required by law.

Shipping, delivery, returns, and refunds

Shipping and delivery are governed by our Shipping Policy. Returns, cancellations, and refunds are governed by our Return and Refund Policy. Those policies form part of these Terms.

Delivery estimates are not guarantees unless applicable law provides otherwise. Risk of loss and legal title pass as required by the law applicable to the transaction; these Terms do not override mandatory consumer protections.

Intellectual property

The store and its content—including Moreno names, logos, product names, photographs, text, graphics, design, and software—are owned by or licensed to Moreno and protected by intellectual-property laws. You may view the store and make purchases for personal use. No other license is granted.

You may not reproduce, distribute, modify, publish, sell, license, or commercially exploit store content without prior written permission, except as permitted by law.

Reviews, messages, and submitted content

If you submit a review, photograph, comment, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s rights. You grant Moreno a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating and promoting the business, subject to applicable law and our Privacy Policy.

We may moderate or remove submitted content that is unlawful, misleading, abusive, infringing, or unrelated, but we are not obligated to monitor every submission.

Third-party services and links

The store relies on third parties, including Shopify, payment providers, carriers, and other service providers. Third-party sites and services may have separate terms and policies. Moreno is not responsible for third-party content or conduct outside its reasonable control, except where applicable law provides otherwise.

Disclaimer

To the fullest extent permitted by law, the store and its content are provided on an “as available” basis. We do not warrant that the store will always be uninterrupted, error-free, or immune from security incidents. Product warranties and consumer guarantees that cannot legally be excluded remain in effect.

Limitation of liability

To the fullest extent permitted by law, Moreno is not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the store or products. Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence, breach of mandatory consumer guarantees, or any liability that cannot legally be limited.

Where liability may legally be limited, Moreno’s aggregate liability concerning a purchase will not exceed the amount paid for the product giving rise to the claim. This limitation does not reduce any remedy required by applicable consumer law.

Indemnity

To the extent permitted by law, you agree to indemnify Moreno against third-party claims resulting from your unlawful misuse of the store, infringement of another person’s rights, or material breach of these Terms. This provision does not apply to ordinary consumer use or where prohibited by law.

Changes and availability

We may update the store, products, and these Terms. The Terms in effect when an order is placed generally govern that order unless a change is required by law or accepted by you. We may suspend or discontinue store functionality when reasonably necessary.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that consumers retain the protection of mandatory laws in their place of residence. Courts located in Los Angeles County, California will have non-exclusive jurisdiction, unless applicable consumer law allows or requires a different forum.

Before filing a claim, please contact info@morenocalifornia.com so we can try to resolve the issue informally. This does not prevent either party from seeking urgent relief or using any consumer dispute process available by law.

Severability and entire agreement

If a provision is found unenforceable, the remaining provisions remain in effect, and the affected provision will be enforced to the maximum lawful extent. These Terms, together with the policies referenced in them, form the agreement concerning use of the store and purchases from Moreno.
